Texas is expanding from 3 to 15 licensed medical cannabis operators under HB 46. Nine companies have already been conditionally approved. Final approval requires DPS due diligence and compliance review.

15 Licenses/ HB 46

15 Vertically Integrated licenses will be issued in the state by April 1, 2026.

Allowed Products Including: 

Vaporizers, Cartridges, Ingestible (Edibles), Inhalers, Transdermal patches, and  Suppositories. 

NO Smokeable Flower Allowed!

Satellite Locations Required

Each license holder will be required to have satellite locations in the given region they are operating in.

Texas Packaging Requirements (DPS-Regulated)


  • Tamper-Evident

    Shows visible signs if opened — protects patients and meets DPS sealed‑package rules.
  • Child-Resistant

    Packaging must be difficult for children under 5 to open, but easy for adults to use.
  • Opaque 

    Product inside cannot be visible — supports medical privacy and prevents youth appeal.
  • Dose-Based Limits

    ≤ 10 mg THC per dose and ≤ 1,000 mg THC per package

NO! Smokable cannabis remains prohibited with the exception of vaporizers and cartridges. 

What products are allowed?

Vapes, cartridges, nebulizers, inhalers, topicals, tinctures, edibles, etc. 

What are Texas THC limits?

10mg per dose, 1,000mg per package under HB 46. 

What are satellite locations and how do they affect packaging requirements?

Satellite locations are DPS‑approved secondary dispensing sites where medical cannabis products can be stored overnight and dispensed to patients, not just handed off. Because these sites must securely hold inventory without direct supervision from the primary facility, Texas requires products to arrive in sealed, tamper‑evident, child‑resistant, and fully compliant packaging that prevents contamination, diversion, or unauthorized access during storage.

This means operators must use fully sealed, medical‑grade packaging for all products shipped to or held inside satellite locations, ensuring compliance even when products are stored away from the main dispensary.
